Federal Prosecutor Fernando Arrigo Accused of Cruel Treatment and Abuse of Power in Argentina

Facundo Jones Huala, an indigenous activist, has suspended his hunger strike that lasted nearly 60 days. Throughout this time, he consumed no food. Over the two months of the hunger strike, many of his existing illnesses and pathological conditions significantly worsened. On June 28 he had been promised a transfer to another prison closer to his mother’s home within 48 hours, and to this day he has still not been transferred.  

 

Despite a court order, he remains in the same facility

 

Supporters claim that he was deceived and effectively forced to risk his life to obtain basic humanitarian conditions.

 

Critics place primary responsibility on Federal Prosecutor Oscar Fernando Arrigo, accusing him of systematic cruel and degrading treatment of prisoners. A similar situation is evident in the case of Russian activist Konstantin Rudnev, which has been under investigation in Argentina for more than a year. According to the published case materials, the defense has completely refuted and dismantled all evidence presented by the prosecution.

 

When Rudnev was being transferred from prison to house arrest, it was Prosecutor Fernando Arrigo who secured the cancellation of the previously approved air transfer, even though all courts had approved the flight and the aircraft was already ready. As a result, Rudnev was forced to travel by land for more than 24 hours — handcuffed, unable to move, without food, water, or even the opportunity to use the toilet. He had been diagnosed with a large inguinal hernia. The grueling transport seriously worsened his condition, leading to an emergency hospitalization and surgery immediately upon arrival. He is currently in serious condition, recovering from the operation.

 

Despite his serious health problems, Prosecutor Arrigo, according to available information, succeeded in having Rudnev’s house arrest revoked and his return to prison ordered. This decision has drawn sharp criticism, especially given the lack of evidence of guilt.

 

An Italian doctor of psychology has publicly spoken out about the prosecutor’s conduct, noting signs of pathological cruelty syndrome in his motives and actions.

The case has attracted significant international attention. Numerous complaints have been filed by individuals and human rights organizations accusing Prosecutor Arrigo of abuse of office and possible falsification of evidence. Most recently, a lawyer of Rudnev from the Inter-American Commission on Human Rights, filed an official complaint demanding the removal of Prosecutor Arrigo from the Konstantin Rudnev case. The complaint has been accepted.

 

The actions of Federal Prosecutor Oscar Fernando Arrigo are currently under close scrutiny by the international community. Human rights defenders emphasize that the treatment of Facundo Jones Huala, Konstantin Rudnev, and other prisoners raises serious concerns regarding compliance with due process, prisoners’ rights, and possible abuse of prosecutorial power in Argentina.

 We therefore call on the competent authorities to conduct a disciplinary investigation into the actions of Fiscal General Dr. Oscar Fernando Arrigo. The investigation must verify whether the prosecutor violated his professional duties (objectivity, loyalty to due process, comprehensive examination of circumstances, respect for the right to defense, protection of the life and health of persons under state custody, etc.).

 

Additionally, 12 European human rights organizations have signed a letter to the Ministry of Justice, the Ministry of Security, and the President of Argentina requesting the removal of Prosecutor Arrigo from the Konstantin Rudnev case.
