A missing pool certificate can delay settlement in Victoria because the law requires every pool or spa to have a valid Form 23 or Form 24 disclosed in the Section 32 vendor statement before a buyer signs. Does Victoria Legally Require a Pool Certificate to Sell?

Yes. If your property has a pool or spa, your Section 32 vendor statement must disclose a valid certificate of barrier compliance or non-compliance.

This sits under the Building Act 1993 and the Building Regulations 2018. 

Your conveyancer cannot leave this out. If the certificate is missing, expired, or was never obtained in the first place, Section 32 is incomplete, and an incomplete Section 32 puts the whole sale at risk, not just the pool. 

It applies whether the pool is a large in-ground fixture or a smaller above-ground setup, since the water depth trigger, not the pool type, decides whether a barrier and a certificate are needed.

What Happens If Section 32 Is Missing the Certificate?

A buyer can use a missing or defective pool certificate as legal grounds to delay or cancel the contract, even after signing.

Victorian law gives buyers the right to walk away before settlement when a Section 32 is incomplete or inaccurate. 

A missing pool certificate is exactly the kind of gap a sharp buyer’s lawyer looks for. Best case, you lose a few weeks sorting it out mid-contract. 

In the worst case, the buyer rescinds, and you start the whole sales process again from scratch, often with a smaller pool of interested buyers the second time around.

Form 23 vs Form 24: What Buyers Actually See

A Form 23 shows a fully compliant barrier. Form 24 shows a barrier that failed and still needs work.

A Form 24 is not the end of the world. Many buyers will still proceed, often with a price adjustment. No certificate at all tends to spook buyers the hardest, since nobody knows what they are actually inheriting.

How Long Does It Take to Fix a Missing Certificate?

Most thorough inspections and certificates are processed within a week, but rectification work can take longer.

Booking an inspector is usually the fast part. 

If your barrier passes outright, you can have a Form 23 in hand within days. If it needs work first, like a new latch or trimming back a garden bed, add on however long that repair takes. 

Either way, starting early gives you room to move before a buyer ever sees the gap.

What Buyers Should Check Before Signing

Buyers should confirm the certificate exists, matches the property, and is recent enough to reflect the current barrier.

  • Ask for Form 23 or Form 24 directly, not just a mention in the contract
  • Check the certificate date against the four-year renewal cycle
  • Confirm the address on the certificate matches the property being sold
  • If only a Form 24 exists, ask what rectification work is still outstanding
